What FCRA compliance is required for Indian NGOs?
Under the Foreign Contribution (Regulation) Act 2010 and FCRR 2011, NGOs must: (1) File annual FC-4 return by December 31; (2) File FC-1 within 45 days of receiving >₹10 lakh from any relative abroad; (3) Publish annual accounts and list of foreign contributions on their website; (4) Maintain a dedicated FCRA bank account (SBI, New Delhi, Main Branch after 2020 amendment). What happened to FCRA quarterly returns?
Rule 13(b) of FCRR 2011 requiring quarterly portal disclosures was omitted by the Ministry of Home Affairs. Quarterly online portal disclosure and the parallel quarterly website publication requirement are no longer mandatory. The annual FC-4 return, FC-1 for large receipts from relatives, and annual website disclosure remain in force.
What are the penalties for FCRA non-compliance?
FCRA violations can result in: suspension of FCRA registration (MHA can suspend for 180 days pending inquiry), cancellation of registration, freezing of FCRA bank account, and criminal prosecution with imprisonment up to five years and fines.
